Welcome to Makom Connect ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Makom Connect platform, website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Makom Connect. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 13 years of age to use the Service. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We may restrict certain features of the Service to users who have provided additional verification or meet specific criteria.
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are solely responsible for maintaining the confidentiality and security of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from unauthorized account access.
Your profile information, including your name, contact details, and other details you choose to share, may be visible to other members of your institution and to platform administrators as determined by your institution's settings. You are responsible for the content you post on your profile and elsewhere on the Service. You agree not to post content that is false, misleading, defamatory, infringing, or otherwise prohibited under these Terms.
You may delete your account at any time through your account settings or by contacting us. We reserve the right to suspend or terminate your account if we believe you have violated these Terms or any applicable law.
The Service may include features that require payment, including membership dues, event tickets, donations, school tuition, catering orders, and other offerings. All payments are processed through our third-party payment processor, Stripe. We do not store your full credit card or payment card details on our servers.
By submitting payment information, you authorize us and our payment processor to charge the designated payment method for the full amount of your purchase, including any applicable taxes and fees. You represent that you are authorized to use the payment method you provide.
Certain features of the Service are offered on a subscription basis with recurring billing. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel a subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and no refunds are provided for partial billing periods unless required by law.
For payments processed through the platform's payment system, a processing fee may apply. This fee is disclosed at the point of purchase. If your institution uses its own payment processor account, different terms may apply as set by your institution.
Refund eligibility depends on the nature of the transaction and the policies set by your institution or the platform. If you believe a charge is incorrect or unauthorized, please contact your institution or us promptly. For credit card disputes, your card issuer's dispute process may also apply. We reserve the right to reverse transactions in cases of fraud, error, or policy violation.
Donations made through the Service are generally non-refundable, except where required by law. Tax deductibility of donations depends on the tax-exempt status of the receiving institution. Makom Connect is not responsible for providing tax advice or tax receipts beyond what is issued by the receiving institution.
You agree not to use the Service to:
You retain ownership of content you submit to the Service, including profile information, messages, and other materials ("User Content"). By submitting User Content, you grant Makom Connect a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the purpose of operating and improving the Service.
You represent that you have all necessary rights to your User Content and that it does not violate these Terms or the rights of any third party. We reserve the right to remove any User Content that we believe violates these Terms or is otherwise objectionable.
The Service, including its design, features, and content not provided by users, is owned by Makom Connect and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.
"Makom Connect" and associated logos and trademarks are trademarks of Makom Connect. All other trademarks are the property of their respective owners.
Makom Connect provides software tools to religious and educational institutions. We are not a party to the relationship between you and your institution, and we are not responsible for the policies, decisions, or actions of individual institutions. Disputes with your institution regarding membership, dues, events, or programs should be resolved directly with your institution.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that results will meet your requirements. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Makom Connect and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid to us through the Service in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
You agree to indemnify and hold harmless Makom Connect and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your User Content, your violation of these Terms, or your violation of any rights of a third party.
The Service may integrate with or contain links to third-party services, including payment processors, email providers, and social media platforms. We are not responsible for the practices or content of these third-party services, and your use of them is subject to their own terms and policies.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitation of liability.
We may modify these Terms from time to time. We will post the updated Terms on our website and update the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in New York, New York, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.
